    Lobbies call for special insurance courts to promote sector

    The Association of Insurance Brokers of Kenya (AIBK) has called for the establishment of special courts to resolve insurance cases.

    AIBK CEO Eliud Adiedo said the current system is choking the sector due to a backlog of numerous cases in courts which leads to prolonged legal battles.

    Adiedo said the judiciary should give insurance cases a priority and come up with special courts to expedite the settlement of disputes and the processing of claims.

     “The government should create insurance courts just like they did to land, labour and others,” he said.

    Adiedo made the remarks during the marking of the 17th AIBK Annual Conference at Diamond Leisure Beach and Golf Resort in Kwale County.

    The CEO said said insurance sector plays a vital role in the economy as it offers financial security against unforeseen events.

    National Chairman of the AIBK Anthony Mwangi said the specialized insurance courts would streamline the legal process give room for arbitration and enhance trust.

    He said insurance courts will provide consistence interpretation and application of insurance laws and enhance consumer protection.

    Mwangi said the courts would handle a spectrum of disputes, from life and health to property and auto insurance.

    The chair said the move aims to foster a robust legal framework, providing insurers and policyholders with certainty and predictability.

    He said the industry experts, legal professionals, and consumer advocacy groups are rallying behind the call for specialized insurance courts because the courts will expedite dispute resolution discourage fraudulent claims and give judges a deeper understanding of the sector

    Mwangi added that legislative support and resource allocation are necessary, proponents assert that the long-term benefits will far outweigh the initial investment, contributing to a more stable and transparent insurance industry.

    He said the establishment of insurance courts is an imperative step that cannot be ignored.

    Mwangi said the courts would address unique challenges, ensuring fair and timely dispute resolution, ultimately benefiting insurers and policyholders.
