    Kwale governor Fatuma Achani win round one of election petition against her victory

    Former Agriculture PS Proffesor Hamadi Boga has suffered a major blow in his election petition against Governor Fatuma Achani after court rejected application for new evidence.

    In an election petition filed in Mombasa court by ODM governor candidate in 2022 election Hamadi Boga through Kwale residents seeking nullification of governor Fatuma Achani victory, seems like the petitioner boat is sinking with hopes dwindling.

    The election petition number 2 of 2022 Dziwe Pala Zuma versus IEBC and 2 others came up for ruling on the Petitoners’ oral application seeking leave to file a supplementary affidavit in order to respond to new issues raised in the Respondents’ response to the petition.

    However the court while throwing away the application by the petitioner

    ruled that none of the issues the Petitioners intended to respond to were new issues.

    The leave sought by the Petitioners to file a Supplementary affidavit was denied by the Court as the Court found the same to lack merit.

    The petitioners will now have to go to the drawing board after indications clearly shown that they had no enough evidence to support their claims.

    Governor Achani of UDA garnered 59,674 votes against Hamadi Boga (ODM), who had 53,972 votes.

    Mr Pala and Mr Ali said in a detailed petition against Achani said that the Kwale gubernatorial polls were marred by voter bribery and other electoral malpractices.

    They want Achani’s election nullified, noting that she was not validly elected, citing “massive irregularities and intimidation”.

    They have instead asked the court to order the Independent Electoral and Boundaries Commission to declare Mr Boga as the validly elected governor.

    They allege that ward administrators were used to visit voters at their homes and unduly influence them to support Ms Achani’s bid by instilling fear.
