Mining Cabinet Secretary Hassan Ali Joho has ordered the immediate suspension of all mining operations by Tata Chemicals Magadi Limited over alleged failure to comply with key legal and regulatory requirements governing Kenya’s mining sector.
In a statement issued on Wednesday, Joho said the suspension will remain in force until the company fully complies with the Mining Act, its regulations and all other applicable laws.
The CS said the action followed years of engagement between the State Department for Mining and the company over its statutory obligations under the Mining Act, Cap. 306, the Mining (Licence and Permit) Regulations 2017, the Mining (Royalty Collection and Management) Regulations 2024 and other legal frameworks.
“This action follows years of engagement with the company over its statutory obligations under Kenya’s mining laws and regulations,” Joho said in the statement.
According to the ministry, the company has failed to resolve several compliance issues, including the absence of a clear mineral beneficiation and value-addition strategy, outstanding royalty reconciliation and payment obligations, and inadequate export reporting and reconciliation.
The ministry also cited poor implementation of Community Development Agreements, insufficient employment and skills transfer programmes for Kenyan citizens, weak local procurement practices, and environmental compliance gaps.
Furthemore CS Joho directed Tata Chemicals Magadi Limited to submit comprehensive documentation demonstrating full compliance with all statutory obligations and settle any outstanding liabilities before mining operations can resume.

Joho said the government remains committed to ensuring that Kenya’s mineral resources are exploited responsibly, sustainably and in a manner that maximizes economic benefits while protecting the environment and the interests of host communities.
